There are two words we use as though they mean roughly the same thing.<\/p>\n\n\n\n

Citizen.<\/strong><\/p>\n\n\n\n

Sovereign.<\/strong><\/p>\n\n\n\n

They don’t.<\/p>\n\n\n\n

At least, they don’t have to.<\/p>\n\n\n\n

One describes a relationship to a political system.<\/p>\n\n\n\n

The other describes a relationship to authority itself.<\/p>\n\n\n\n

And once you notice the distinction, some very old ideas begin looking strangely contemporary.<\/p>\n\n\n\n

\n\n\n\n

The Citizen Has Paperwork<\/h2>\n\n\n\n

A citizen is, in the most ordinary modern sense, a person recognized by a state as belonging to it.<\/p>\n\n\n\n

There is a record.<\/p>\n\n\n\n

A birth certificate.<\/p>\n\n\n\n

A passport.<\/p>\n\n\n\n

A national identification number.<\/p>\n\n\n\n

A citizenship document.<\/p>\n\n\n\n

A database entry.<\/p>\n\n\n\n

Some piece of paper, plastic, ink, or increasingly, digital information that says:<\/p>\n\n\n\n

This person belongs to this political body.<\/strong><\/p>\n\n\n\n

That isn’t necessarily bad.<\/p>\n\n\n\n

Civilization runs on records.<\/p>\n\n\n\n

Records allow people to establish identity, inherit property, vote, cross borders, receive services, enter contracts, and participate in institutions.<\/p>\n\n\n\n

But the record reveals something important.<\/p>\n\n\n\n

Citizenship is a legal relationship<\/strong>.<\/p>\n\n\n\n

The state recognizes you.<\/p>\n\n\n\n

And because it recognizes you, it can also define the conditions under which that recognition operates.<\/p>\n\n\n\n

\n\n\n\n

The Sovereign Is a Different Idea<\/h1>\n\n\n\n

Sovereignty points in the opposite direction.<\/p>\n\n\n\n

The sovereign person is not first defined by the state’s recognition.<\/p>\n\n\n\n

They are a person who understands themselves as possessing an inherent moral and natural standing that exists before paperwork<\/strong>.<\/p>\n\n\n\n

This is where ancient ideas such as natural law become interesting.<\/p>\n\n\n\n

The language of the Hebrew scriptures, the Greek philosophers, Roman natural-law traditions, and later European political philosophy all developed different versions of the idea that there are principles of right and wrong that do not originate merely because a government wrote them down.<\/p>\n\n\n\n

You don’t become human because a government issued you a document.<\/p>\n\n\n\n

You don’t acquire the capacity for conscience because a clerk stamped a form.<\/p>\n\n\n\n

You don’t become capable of recognizing justice because a legislature passed an act.<\/p>\n\n\n\n

The document recognizes something.<\/p>\n\n\n\n

It doesn’t create everything.<\/p>\n\n\n\n

That distinction matters.<\/p>\n\n\n\n

\n\n\n\n

Born Into the Law<\/h1>\n\n\n\n

There is an old way of thinking about this:<\/p>\n\n\n\n

You are born into a world governed by laws you did not write.<\/strong><\/p>\n\n\n\n

Natural law.<\/p>\n\n\n\n

Moral law.<\/p>\n\n\n\n

The law of Moses.<\/p>\n\n\n\n

Divine law.<\/p>\n\n\n\n

The law of nature.<\/p>\n\n\n\n

Different traditions have given the idea different names.<\/p>\n\n\n\n

But the common intuition is familiar:<\/p>\n\n\n\n

There are some things you ought not do even if the government tells you that you may.<\/p>\n\n\n\n

There are some things you ought to do even if the government tells you that you may not.<\/p>\n\n\n\n

That is the philosophical territory of sovereignty.<\/p>\n\n\n\n

The sovereign question is not merely:<\/p>\n\n\n\n

What am I legally permitted to do?<\/strong><\/p>\n\n\n\n

It is:<\/p>\n\n\n\n

What is right?<\/strong><\/p>\n\n\n\n

\n\n\n\n

Socrates and the Problem of Belonging<\/h1>\n\n\n\n

Consider Socrates.<\/p>\n\n\n\n

The popular story is that Socrates was condemned to death by Athens and chose to remain rather than escape.<\/p>\n\n\n\n

But the situation is more interesting than a simple story of a man choosing death.<\/p>\n\n\n\n

Socrates was deeply embedded in the civic world of Athens.<\/p>\n\n\n\n

He was tried by its institutions.<\/p>\n\n\n\n

He was condemned under its laws.<\/p>\n\n\n\n

And in Plato’s Crito<\/em>, the argument for remaining is partly an argument about the relationship between the individual and the city that raised him.<\/p>\n\n\n\n

Escape would not simply mean walking away from a building.<\/p>\n\n\n\n

It would mean violating the legal and civic order in which his entire life had been situated.<\/p>\n\n\n\n

And there was another reality behind ancient citizenship that modern people can easily miss.<\/p>\n\n\n\n

Where you belonged mattered enormously.<\/strong><\/p>\n\n\n\n

Outside the civic structure of the polis, an aging man without wealth, family connections, or a secure place could be extraordinarily vulnerable.<\/p>\n\n\n\n

Property belonged to someone.<\/p>\n\n\n\n

Political rights belonged to citizens.<\/p>\n\n\n\n

Protection depended heavily on relationships and status.<\/p>\n\n\n\n

The ancient world did not contain our modern network of social safety nets.<\/p>\n\n\n\n

So the question wasn’t simply:<\/p>\n\n\n\n

Why didn’t Socrates run away?<\/strong><\/p>\n\n\n\n

It was:<\/p>\n\n\n\n

What does it mean to belong to a city, and what happens when you cease belonging?<\/strong><\/p>\n\n\n\n

That question is still alive.<\/p>\n\n\n\n

\n\n\n\n

The Words Changed<\/h1>\n\n\n\n

Modern civilization has changed enormously.<\/p>\n\n\n\n

But the underlying categories didn’t completely disappear.<\/p>\n\n\n\n

We still distinguish people according to their relationship with political institutions.<\/p>\n\n\n\n

Citizen.<\/p>\n\n\n\n

Foreigner.<\/p>\n\n\n\n

Immigrant.<\/p>\n\n\n\n

Refugee.<\/p>\n\n\n\n

Resident.<\/p>\n\n\n\n

Nonresident.<\/p>\n\n\n\n

Undocumented person.<\/p>\n\n\n\n

Traveler.<\/p>\n\n\n\n

Expatriate.<\/p>\n\n\n\n

Alien.<\/p>\n\n\n\n

These words are not all equivalent, and they have very different legal meanings.<\/p>\n\n\n\n

But notice what they do.<\/p>\n\n\n\n

They describe someone’s relationship to a jurisdiction<\/strong>.<\/p>\n\n\n\n

The paperwork tells the system where you stand.<\/p>\n\n\n\n

And sometimes the lack of paperwork tells the system where you stand too.<\/p>\n\n\n\n

\n\n\n\n

The Person Without the Paper<\/h1>\n\n\n\n

Here is where the sovereignty metaphor becomes useful\u2014but also where we have to be careful.<\/p>\n\n\n\n

A person lacking citizenship documentation is not automatically a sovereign person in the philosophical sense.<\/p>\n\n\n\n

An undocumented immigrant isn’t secretly outside the law.<\/p>\n\n\n\n

A foreigner isn’t automatically sovereign.<\/p>\n\n\n\n

A traveler isn’t automatically sovereign.<\/p>\n\n\n\n

Legal status and philosophical sovereignty are different categories.<\/p>\n\n\n\n

But the distinction reveals something important:<\/p>\n\n\n\n

The absence of paperwork can change how a person is treated by the political system without changing their fundamental humanity.<\/strong><\/p>\n\n\n\n

The person remains a person.<\/p>\n\n\n\n

Their conscience remains theirs.<\/p>\n\n\n\n

Their body remains theirs.<\/p>\n\n\n\n

Their capacity for reason remains theirs.<\/p>\n\n\n\n

Their moral agency remains theirs.<\/p>\n\n\n\n

The state can change their legal status.<\/p>\n\n\n\n

It cannot manufacture their humanity from nothing.<\/p>\n\n\n\n

\n\n\n\n

The Amish and Mennonites<\/h1>\n\n\n\n

Now consider communities such as the Amish and Mennonites.<\/p>\n\n\n\n

Again, not every member of these traditions would describe themselves using the word sovereign<\/strong>, and their relationships with governments vary.<\/p>\n\n\n\n

But some communities deliberately maintain a degree of separation from mainstream institutions.<\/p>\n\n\n\n

They preserve distinct religious practices.<\/p>\n\n\n\n

They maintain communal structures.<\/p>\n\n\n\n

They resist certain forms of modern technology.<\/p>\n\n\n\n

They emphasize community responsibility over individualistic cultural norms.<\/p>\n\n\n\n

They negotiate their relationship with the surrounding state rather than simply dissolving themselves into it.<\/p>\n\n\n\n

This is an important distinction.<\/p>\n\n\n\n

Sovereignty does not necessarily mean isolation.<\/strong><\/p>\n\n\n\n

A community can interact with a government without making the government the source of every aspect of its identity.<\/p>\n\n\n\n

\n\n\n\n

The Trap in “Sovereign Citizen”<\/h1>\n\n\n\n

And this is where language gets particularly interesting.<\/p>\n\n\n\n

The phrase sovereign citizen<\/strong> sounds like it combines both concepts.<\/p>\n\n\n\n

But if we’re being precise, it creates a contradiction.<\/p>\n\n\n\n

A citizen is someone whose political membership is defined by a state.<\/p>\n\n\n\n

A sovereign is, by definition, someone whose authority is not simply derivative of that state’s recognition.<\/p>\n\n\n\n

So when someone says:<\/p>\n\n\n\n

Sovereign citizen<\/strong><\/p>\n\n\n\n

we should ask:<\/p>\n\n\n\n

Which meaning of sovereign?<\/strong><\/p>\n\n\n\n

If they mean:<\/p>\n\n\n\n

\n

“A citizen who possesses fundamental rights and moral agency that the government cannot legitimately erase,”<\/p>\n<\/blockquote>\n\n\n\n

then we are discussing a perfectly recognizable philosophical idea.<\/p>\n\n\n\n

If they mean:<\/p>\n\n\n\n

\n

“A person can declare themselves outside laws that apply to everyone else simply by refusing the jurisdiction or paperwork,”<\/p>\n<\/blockquote>\n\n\n\n

that’s a different claim\u2014and generally not how modern legal systems work.<\/p>\n\n\n\n

The words sound similar.<\/p>\n\n\n\n

The legal realities are not.<\/p>\n\n\n\n

\n\n\n\n

The Freerange Corporate Worker<\/h1>\n\n\n\n

There’s another way to make the joke.<\/p>\n\n\n\n

A modern citizen can sometimes look like:<\/p>\n\n\n\n

a freerange corporate worker for the jurisdiction in which they live.<\/strong><\/p>\n\n\n\n

You are born.<\/p>\n\n\n\n

The state records it.<\/p>\n\n\n\n

You receive an identity.<\/p>\n\n\n\n

You acquire rights.<\/p>\n\n\n\n

You acquire obligations.<\/p>\n\n\n\n

You pay taxes.<\/p>\n\n\n\n

You enter contracts.<\/p>\n\n\n\n

You obtain licenses.<\/p>\n\n\n\n

You interact with institutions.<\/p>\n\n\n\n

You eventually die.<\/p>\n\n\n\n

And somewhere along the way, an enormous amount of your existence gets translated into administrative records.<\/p>\n\n\n\n

That isn’t necessarily sinister.<\/p>\n\n\n\n

It’s civilization.<\/p>\n\n\n\n

But bureaucracy has a peculiar talent for making the record of a person feel more real than the person.<\/p>\n\n\n\n

\n\n\n\n

The Sovereign Refuses the Substitution<\/h1>\n\n\n\n

The philosophical sovereign says:<\/p>\n\n\n\n

The record is not me.<\/strong><\/p>\n\n\n\n

The passport is not me.<\/p>\n\n\n\n

The driver’s license is not me.<\/p>\n\n\n\n

The tax number is not me.<\/p>\n\n\n\n

The government database is not me.<\/p>\n\n\n\n

The job title is not me.<\/p>\n\n\n\n

The social security number is not me.<\/p>\n\n\n\n

The legal category is not me.<\/p>\n\n\n\n

Those things may describe relationships I have with institutions.<\/p>\n\n\n\n

They may be extremely important.<\/p>\n\n\n\n

But they are not the totality of the person.<\/p>\n\n\n\n

That distinction is psychologically powerful.<\/p>\n\n\n\n

Because once you understand it, you can participate in civilization without allowing civilization to become your entire ontology.<\/p>\n\n\n\n

\n\n\n\n

Sovereignty Isn’t Exemption<\/h1>\n\n\n\n

This is the part worth getting right.<\/p>\n\n\n\n

Sovereignty does not<\/strong> mean:<\/p>\n\n\n\n

Nobody can tell me what to do.<\/strong><\/p>\n\n\n\n

That’s not sovereignty.<\/p>\n\n\n\n

That’s just refusing accountability.<\/p>\n\n\n\n

A sovereign person still has consequences.<\/p>\n\n\n\n

They still have neighbors.<\/p>\n\n\n\n

They still inhabit shared reality.<\/p>\n\n\n\n

They still have to negotiate with other people.<\/p>\n\n\n\n

They still have to answer for what they do.<\/p>\n\n\n\n

The deeper form of sovereignty is not exemption from law.<\/p>\n\n\n\n

It is responsibility for one’s own authority<\/strong>.<\/p>\n\n\n\n

You don’t get to say:<\/p>\n\n\n\n

I am sovereign, therefore I can hurt you.<\/strong><\/p>\n\n\n\n

You have to ask:<\/p>\n\n\n\n

What gives me the right to do this?<\/strong><\/p>\n\n\n\n

And then you have to live with the answer.<\/p>\n\n\n\n

\n\n\n\n

Two Kinds of Law<\/h1>\n\n\n\n

Perhaps this is the most useful distinction.<\/p>\n\n\n\n

There is the law that says:<\/p>\n\n\n\n

What will the state permit or punish?<\/strong><\/p>\n\n\n\n

And there is the law that asks:<\/p>\n\n\n\n

What ought a human being do?<\/strong><\/p>\n\n\n\n

Sometimes they overlap beautifully.<\/p>\n\n\n\n

Sometimes they don’t.<\/p>\n\n\n\n

The mature person needs to be capable of recognizing both.<\/p>\n\n\n\n

You can obey a law you dislike because you understand the consequences of violating it.<\/p>\n\n\n\n

You can also peacefully resist a law you believe is unjust.<\/p>\n\n\n\n

You can participate in government without worshipping government.<\/p>\n\n\n\n

You can possess citizenship without surrendering your conscience to government.<\/p>\n\n\n\n

You can be a citizen and still remember that you are a human being first.<\/p>\n\n\n\n

\n\n\n\n

The Paper and the Person<\/h1>\n\n\n\n

The state needs paperwork.<\/p>\n\n\n\n

That’s okay.<\/p>\n\n\n\n

Paperwork lets millions of strangers coordinate with one another.<\/p>\n\n\n\n

But the paperwork should remain what it is:<\/p>\n\n\n\n

a tool for describing a person.<\/strong><\/p>\n\n\n\n

Not the source of the person’s humanity.<\/p>\n\n\n\n

The document says:<\/p>\n\n\n\n

This person belongs here.<\/strong><\/p>\n\n\n\n

Sovereignty remembers:<\/p>\n\n\n\n

This person existed before the document.<\/strong><\/p>\n\n\n\n

The citizen understands:<\/p>\n\n\n\n

I participate in this political order.<\/strong><\/p>\n\n\n\n

The sovereign remembers:<\/p>\n\n\n\n

I am responsible for what I do within it.<\/strong><\/p>\n\n\n\n

Those aren’t necessarily enemies.<\/p>\n\n\n\n

They can be two layers of the same human being.<\/p>\n\n\n\n

\n\n\n\n

The Question of Sovereignty<\/h1>\n\n\n\n

So perhaps the real question isn’t:<\/p>\n\n\n\n

Am I a citizen or a sovereign?<\/strong><\/p>\n\n\n\n

Perhaps it is:<\/p>\n\n\n\n

Where does my authority come from?<\/strong><\/p>\n\n\n\n

What part of your life comes from the state?<\/p>\n\n\n\n

What part comes from your family?<\/p>\n\n\n\n

What part comes from your community?<\/p>\n\n\n\n

What part comes from your conscience?<\/p>\n\n\n\n

What part comes from nature?<\/p>\n\n\n\n

What part comes from your relationship with God?<\/p>\n\n\n\n

What part comes from principles you would uphold even if nobody rewarded you for doing so?<\/p>\n\n\n\n

And then the harder question:<\/p>\n\n\n\n

Which of those authorities are you willing to examine?<\/strong><\/p>\n\n\n\n

Because sovereignty isn’t the absence of authority.<\/p>\n\n\n\n

It is knowing which authorities you have accepted and why.<\/strong><\/p>\n\n\n\n

\n\n\n\n

The Two Words<\/h1>\n\n\n\n

Citizen.<\/p>\n\n\n\n

Sovereign.<\/p>\n\n\n\n

One tells you:<\/p>\n\n\n\n

Where you stand in relation to a state.<\/strong><\/p>\n\n\n\n

The other asks:<\/p>\n\n\n\n

Who are you when the state is not in the room?<\/strong><\/p>\n\n\n\n

The citizen has paperwork.<\/p>\n\n\n\n

The sovereign has responsibility.<\/p>\n\n\n\n

The citizen belongs to a jurisdiction.<\/p>\n\n\n\n

The sovereign belongs to reality.<\/p>\n\n\n\n

And a mature human being can understand both.<\/p>\n\n\n\n

They can carry a passport without mistaking it for a soul.<\/p>\n\n\n\n

They can obey a law without confusing legality with morality.<\/p>\n\n\n\n

They can participate in civilization without surrendering their conscience to its machinery.<\/p>\n\n\n\n

They can know their rights without forgetting their obligations.<\/p>\n\n\n\n

They can stand inside the system while remembering that they are larger than the box the system uses to describe them.<\/p>\n\n\n\n

Perhaps that is the real distinction.<\/p>\n\n\n\n

Not citizen versus sovereign<\/strong>.<\/p>\n\n\n\n

But:<\/p>\n\n\n\n

the person as recorded,<\/strong><\/p>\n\n\n\n

and<\/p>\n\n\n\n

the person who actually exists.<\/strong><\/p>\n\n\n\n

The paperwork is useful.<\/p>\n\n\n\n

But the person was here first.<\/p>\n\n\n\n
